EEOC Appeal

Tuan Nguyen and his countrymen started defaming Mona Chu “no one liked her; no one wanted her; etc” the first month on the job in the Training Academy.  Ms. Chu had never met Tuan Nguyen or his countrymen in her life.  Ms. Chu just moved to the DC metro for the job and only know one person here. Classmate Shawn Joseph spread to other Training classes in the Training Academy, the Training classes spread to their Art Unit and the rest of the patent office, where they spread to their friends, family, neighbors and neighborhoods like Arlington Va.  As the result, I can't get a job.

Jessica  Jung-Mu T Chuang had asked Tuan Nguyen why did Tuan Nguyen slandered Ms. Chu.

Paul Rodriguez set Mona Chu up to be terminated from the get-go since the Training Academy Dec, 2010 as Ms. Chu is Chinese and female, evidenced  by deliberately gave Ms. Chu a low performance review on her 4th month evaluation when Ms. Chu already had an airtight first case known to many Supervisors and Mr. David Kappos - ex-Under Secretory of the Patent and Trademake office.  When Ms. Chu has shown she could do the 3 COPA cases per biweek in June, 2011, Mr. Rodriguez hastens Ms. Chu’s termination before her 1 year probationary period end on Nov, 9, 2011, by making every effort to make her job difficult from confined to use only Agency’s EAST search tool to not allowed helps from Simon Ke, and put difficult COPA cases on Ms. Chu’s docket.  When that didn’t work as Ms. Chu was able to meet the 3 cases per biweek.  In July, 2011, Mr. Rodriguez asked Ms. Chu to re-do a case that’s already accepted for credit and refused to accept anything from Ms. Chu to justify Ms. Chu's termination as indicated in their July 27-28 email (chu production 1.pdf page 555-556) when they already decided to terminate Ms. Chu.

Director Wendy Garber, Zachary Clifton and other management agreed to terminate Mona Chu partially due to the defamation of Mona Chu by Dwin Craig, Hung Havan and his cabal - Nathan Hillery – a Union Rep, Michele Choi, Susanne Lo and her AU2128 Indian friends, and Tuan Nguyen and his countrymen as the result of discrimination toward Ms. Chu as stated in the Formal Complaint in no less than 20 pages.  All these defamation resulted in sexual harassment and a hostile working environment for Ms. Chu which she had to take frequent sick leaves in late June and July of 2011 that resulted in productivity drop from 103% to 50% or less.  Defamation by Hung Havan (Ms. Chu’s officemate) such as Ms. Chu and Susanne Lo’s boyfriend Bill (in charge of COPA event) will be married soon (against Agency policy), whom Ms. Chu has only spoken to a few times as she worked nearly 24/7 and didn’t even know his last name.  It is well know Bill and Susanne Lo been dating for years, we saw them going home together all the time.  Additionally, Hung Havan and Michele Choi used their smartphones to set Ms. Chu up such she would come across as if she was checking him out to incite sexual harassment, abuse, termination and rape threats.  Furthermore, Hung Havan defamed Ms. Chu says she is just like Michele Choi who is hated everywhere, especially by Dwin Craig; which Mr. Craig then told Wendy Garber and other management; and Mr. Rodrigues very much willing to use this to terminate Ms. Chu.  

Before terminating Ms. Chu, Wendy Garber, Zachary Clifton and management confirmed this with Hung Havan; hence the “argumentative” in Ms. Garber’s affidavits over and over again (ROI page 000136 – 000140) even though Ms. Chu has only spoken to Ms. Garber once on June 2, 2011, as well gave Mr. Rodriguez a reason to terminate Ms. Chu even though they communicated via email and Office Action only and Ms. Chu has only seen Mr. Rodriguez less than 5 times after Ms. Chu joined AU2123, while working nearly 24/7 as evidenced by her computer log time.


Without the defamation instigated by Tuan Nguyen and his countrymen/women the first month we all (200-300 new hired Patent Examiners) started the job in the UPSTO’s Training Academy, promulgated by classmates such as Shawn Joseph, Randy Shaffer and Reza Nabi, and re-enforce by officemate Hung Havan and his cabal Nathan Hillery (a Union Rep.), Michele Choi, Susanne Lo and her friends from India, I probably wouldn't be terminated in such a haste, as these people had full control of the USPTO using defamation.  But Paul Rodriguez would terminated me at the last day of my probationary term as he was setting me up from the get-go; as such, Ms. Chu had to work nearly 24/7 as evidenced by her computer log time, and hadn't seen daylight since she started the job.    The USPTO continues to take these people's word at face value even after the USPTO learned their defamation led to my termination; you just can not make this up! 

All above people could barely do their job, and had shown such pernicious intention toward Ms. Chu, in addition to the 2 failed attempt beheading on Ms. Chu, yet they are all still gainfully employed, while Ms. Chu worked nearly 24/7 with unprecedented accomplishments, yet terminated in a haste of 2 days, why is that?   

 
Nathan Hillery had elbowed Ms. Chu on the chest outside of her office on his way home one night. Michele Choi had elbowed Ms. Chu on the chest to push Ms. Chu out of her way after she looted Ms. Chu's office supply on Ms. Chu's last day. Hung Havan used force to stop Ms. Chu from saying goodbye to Erica, a Chinese-American woman down the hall from Ms. Chu's office.  On Ms. Chu last day, when she went to say goodbye to Erica, Hung Havana was talking to Erica outside of her doorway.  Ms. Chu attempted to walk inside to her office, Hung suddenly stretched his arm out such Ms. Chu's chest/breast hit his arm.  Ms. Chu had to push his arm out of her way.  Erica asked him why he did this, he shrugs his shoulder as if to say "she is fired, what is she going to do?"  Then Hung Havan stood in the middle of the hallway to block Ms. Chu from going to say goodbye to other coworkers, which left only one way of the hallway for Ms. Chu to go, and that is back to her office. Ms. Chu went back to her office, packed up and left the Agency for good.

Ms. Garber knew Ms. Chu was perfectly capable of doing her job as indicated in one of Ms. Garber’s email acknowledged Ms. Chu is “smart” (chu production 1.pdf page 621).

Sister Unit AU2128 was predominately Asians and women during the time (March, 2011) when Mona Chu was there, many were originally transferred from AU2123; while AU2123 had only one woman Mary Jacob and one Asian male who was an Engineering Professor when Ms. Chu was there.  One to two women transferred out of AU2123 when Ms. Chu transferred into AU2123.  Then a new hired woman Sheela Rao when Ms. Chu was in AU2123, she’s also transferred out of AU2123 by Paul Rodriguez in 2012.  A supervisor QZ Wang of AU2629 wanted Ms. Chu to transfer into his Unit before her termination, yet Mr. Rodriguez talked him out of transferring Ms. Chu into his Unit (chu production 1.pdf page 621).  Howard Locker, a Union VP also tried to make Ms. Chu’s case to Wendy Garber and asked for an extension until Ms. Chu’s 1 year probationary period (chu production 1.pdf page 636) to no avail.

Mona Chu met every stringent requirement even though there is no production requirement for probationary employees as stated in both Paul Rodriguez and Ms. Garber's affidavits, and Ms. Chu worked nearly 24/7 with an air-tight first case which is known to Mr. David Kappo – Director of the Agency/Patent and Trademark Office, 2 consecutive 3 COPA cases-per-bi-week right after the 6th month evaluation, 93% Productivity and a total of 19 cases including COPA cases soon after the 8th month evaluation.  In addition to Ms. Chu's qualifications: a Master’s degree in Electrical Engineering(ROI page 000025), was pursuing a PhD while at the same time pursuing a second Master’s in Computer Science, as an adjunct in college, research in Applied Physics and published paper(ROI page 000028, http://www.opticsinfobase.org/ao/abstract.cfm?uri=ao-32-21-3944).  Furthermore, extensive industry experiences and outstanding accomplishments in the same field as the patent class– Simulation, Emulation and Modeling (see my resume (chu production 1.pdf page 29-30)) where Ms. Chu led projects.

Ms. Chu had a history of outstanding accomplishments in a male dominated Engineering field and academia which Ms. Chu had to work nearly 24/7 to achieve such result.  Yet Mona Chu is terminated as the resulted of discriminations toward her as a Chinese and female when Mr. Rodrigues realized Ms. Chu was perfectly capable of doing 3 COPA cases per biweek without any help and under extreme condition put on by Mr. Rodrigues and Ms. Garber. 

The fact that key people Mona Chu named in her Formal Complaint were either demoted or fired speak volume.
