COMPLAINANT AMENDED FORMAL COMPLAINT

 

 

 

Describe the action(s) or policy(ies) you believe was (were) discriminatory.  Be specific and include dates. 

 

I was wrongfully terminated as the result of the following:

 

  1. Discrimination of sex and race, as a Chinese and female.
  2. Discrimination based on national origin – in my case, being a Chinese-American perceived as Americanized by people-from-Asia.
  3. Due to discriminations, I had been subjected to a hostile working environment and sexual harassment, to finally terminate.
  4. The termination happened so abruptly, I never had the opportunity to defend my case.

 

Summary:  I was wrongfully terminated due to Discrimination of race and sex, as a Chinese and female.  Also discrimination based on national origin – as a Chinese-American perceived as Americanized by people-from-Asia.

I believed my termination is the resulted of discrimination toward me as Chinese and a female because there is no other Chinese and female in AU2123.  As a matter of fact, there is only one other female who just joined our Art Unit, and maybe one other female that telework, in a Unit of about 15+ people with many telework.    

 

I am also one of the top performers in this AU2123 and AU2128 at 19 cases and 93% on the 8th month FCIP Form (Productivity Performance evaluation), an air-tight first case, and 2 consecutive 3 cases per biweek on the 6th month evaluation; as well my performance had been in an ideal logarithmic upward curve.  In addition to one of the most qualified with a Master’s degree in Electrical Engineering, as an adjunct, research in Applied Physics and published paper.  Furthermore, extensive industry experiences in this field– Simulation, Emulation and Modeling where I led projects.  I maybe the first woman to have an air-tight first case in this Unit/Class/USPTO.  I believed this Unit – AU2123, TC2100 and other Technology Centers (TC) have a history of discrimination again women, and my termination was to keep top performing Chinese-American and women such me down. 

 

Due to discriminations, I had not just been subjected to a hostile working environment and sexual harassment that caused me to take frequent sick leaves as well resulted in my Bi-weekly Productivity performance dropped from 103% to 50%;  also resulted in termination. 

 

This Unit, as well most Technology Centers (TC) had a history of discriminatory practices and abuses toward probationary employee with new hired drop-out rate of 75%.  Another word, 75% of the new hired dropped-out/fired/terminated; they even terminated someone like me who just wanted to do a good job and one of the top performers in the history of this Unit/Class.  I believed other TCs have similar new hired drop-out rate as well.  It is a glaring sign of discriminatory practices and incompetency from all levels of management that created great pains and suffering for many and me.  The working environment is comparable to FoxConn, this is just appalling.  

 

I was also continuously subjected to sexually harassed and abused since the first month I started this job until I was terminated, by people incited and radicalized by Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen, Shawn Joseph, Reza Nabi, Nathan Hillery, Hung Havan and Michele Choi.  They targeted me because they have deep-seated hatreds toward women outperformed them, and women such as me - a neophyte, is an easy target. 

 

I now see why such a gross flagrant miscarriage of justice – the discriminatory practices and abuses of probationary employees by USPTO’s Technology Centers (TC) for such a long time; Unions- mainly POPA, and the legal professions are reluctant to help or represent terminated probationary employees, as I learned; while the incompetency from all levels of management with weak technological understanding of the art that don’t know what it take to do the job, created great pains and suffering for many and me.

 

Discrimination based on national origin – a Chinese-American discriminated for being Americanized in America, by people-from-Asia.  Women such as me – a 2nd class citizen in their culture are an easy target for them.  They started promulgating “no one liked her; no one wanted; she needed a man”, a smear campaign against me the first month I started the job in DC, to incite resentments, sexual harassment and abuses, and finally terminated.  This also happened to me in the San Francisco Bay Area/Silicon Valley as soon I started my first job and never stop until I left due to physical harm threats from them; then followed when I moved to NYC, and now DC.  The way they identified me as Americanized is the same way people identified gay, by appearance and demeanor. 

 

 

1.     The termination happened so abruptly, I never had the opportunity to defend my case. 

 

a.       The termination happened so suddenly and quickly, that I never had a chance to defend my case.  I was told by Paul Rodriguez, my SPE, on Aug. 10, 2011, that I will be meeting with Wendy Gerber on Aug. 11, 2011 to be terminated; effective date will be on Aug. 12, 2011.  I asked why, he cited poor performance, etc.  I said my production performance was at 93%, and asked for more time.  He said this decision is from top management.  As soon I got back to my office, I sat down and still tried to finish a patent case.  That’s how sudden this news was, how entrenched I was in my patent examining job, and how crazy my working condition was.  I hadn’t seen day light for months after I started this job.  I only had time to visit my family once in NYC.  I requested for vacation to move my belongings from NYC, but only approved for one day.

 

b.      On Aug. 11, 2011, I met with Paul Rodriguez and Wendy Gerber in her office.  As soon I sat down, Wendy Gerber presented me the termination letter, cited she wanted 3 cases per bi-week.  Apparently, my Productivity-Last-4-Bi-weeks at 93%, 2 consecutive 3 cases on June 7 and June 22, 2011, and 19 cases in 8 months weren’t good enough, but good enough for everyone else!  Why such discrepancy?  It is obviously because I am Chinese and a woman.   Also, I was sick (Sick Leave, ~7/2011) frequently at that time due to defamation and sexual harassments, which hindered me from completing 3 cases per bi-week, but still able to achieve 93% Productivity performance; not to mention we were still using antediluvian computer hardware (Pentium 4 CPU!!) and software (no intelligent in the search engine whatsoever, as dumb as a rock!!) from the Stone Age; it was just simply cruel and unusual punishment for someone like me from the Silicon Valley.    Also, I’ve done 3 cases per bi-week, proven I could complete the assignment given the right environment.  

 

Wendy cited that I have the option of being terminated or resigned.  If I didn’t resigned by 8/12/2011, termination will go on my permanent record.  There seems to be no other alternative, this is final.  So I said “is there other alternative?” Wendy said no in a stern face.  I certainly didn’t want to be dragged out by security guards.  It is clear that either I resigned or being terminated as which would go into my permanent record, and would not look good in seeking a new job, or my career for that matter if I ever wanted to work again, and I am a career woman with a Master’s degree in Electrical Engineering.  So I shook Paul Rodriguez’s hand and thanked him for teaching me patent examining and thanked Wendy for her time.  I am always a professional.

 

c.       My 1 year probation will end in Nov. 7. 2011, 3 more months, why such a hurry to get-rid of me?  It is not that I performed poorly.  I was one of the top performers at 93%, with an air-tight first case.  This is also known to Mr. David Kappo – Director of the Patent and Trademark Office; disclosed to by the head of the Nov. 2010 Training Academy Andrea Wellington, when I was in the Training Academy (aka Boot-camp).  Mr. Kappo said "good, how do we find more people like her".  

 

Is there any way to let Mr. Kappo know that his problem is not finding people like me, but to keep top performers like me?  We are targeted and terminated; women in particular.  In my case, in just 8 months, while being the subject of sexual harassments. 

 

d.      Such haste to terminate me as if they had something to hide, what are they up to?  Why is everyone discriminated against me when I spent nearly 24/7 working on my computer?  What is Zachary Clifton’s role in my termination?  Why was he discriminating against me for being Asian and a female? 

 

Needless to say, something is rotten in the state of Denmark.  Why such witch-hunt on me?  I deliberately stayed low key and not be seen such no one knows I existed or alive.

 

2.     Discrimination of race and sex, as a Chinese and female.

a.       The mere fact I am terminated based on low performance from the Termination Letter, when I am one of the top performers at 93% Productivity, an air-tight first case, and my performance had been in an ideal logarithmic upward curve, in addition to working nearly 24/7 in front of my computer, as well had worked over 36 hours straight, as evidenced by my computer log time; yet I am terminated because I am the only Chinese and female, and outperformed most males as a way to keep women down.

 

b.      Sister Unit AU2123 was predominately Asians and women when I was there in March 2011.

 

c.       My job requirements are more stringent than most if not all probationary employees.

 

d.      My performance is better than most within my Art Unit 2123 on their 8th month probationary period.  This is obviously discrimination toward me as a woman and as a Chinese-American.  I am the only Chinese female in this Art Unit 2123, yet I am being terminated even though I outperform many in this Art Unit.

 

e.       Compare my performance to my old AU2128; I perform better than most males in this AU in their 8th month as a probationary employee, if not all.  Evidence of discrimination toward top women performer.

 

f.       On my Employee Evaluation/Assessment/Individual Development Plan, there is a huge discrepancy between my Productivity last 4 bi-week at 93% and the rest of the evaluation.  This is analogous to saying I win 93% of the cases, but I didn’t know what I was doing.   This just doesn’t jibe.  I was setup to be terminated since the Training Academy.  This is discrimination toward me as a Chinese and female.   

 

g.      A print-out of Employee Evaluation/Assessment/Individual Development Plan is blurred; one can barely read the information.  Paul Rodrigues said is due to his printer out of ink.  I believed he is intended to deceive.  The Termination Letter came out just find; also he could send to another printer.  He did not want people to know my performance and his intended to set me up to be terminated, as the result of his discrimination toward me as a Chinese and female.

 

h.      Employee Evaluation/Assessment/Individual Development Plan:  4. Ability to understand technology - changed from 2 to a 1 as if I suddenly forgot all my understanding of technology.  I spoke to Paul Rodrigues extensively on varieties of technical concepts during training, in our lab class.  The whole class heard it, as well Simon (aka Peng Ke) – Paul’s assistant.  SPE Kamini Shah whom I respected, Primaries Jason Procter (AU2123) and David Silver (AU2128) are from this Art and understand my competency in this Art.  As a matter of fact, my first case as an air-tight case resulted from talking extensively with Paul.  I picked his brain on patent examining, and I know my techs, particularly VLIW processor (which my first case was on, as I followed the progress of VLIW since 1995). 

 

Also, I’ve worked in the High Tech industry in exactly AU2123 patent field – Simulation, Emulation and Modeling.  As a matter of fact, at the time, I was one of the few, if not the only one that was able to run this type of multi-million dollars Emulation project from scratch to mass production, on time and within budget, no less.  When this news got around, the males, particularly those from Asia, started changing to “the first female to do emulations”, and slandered and degraded me ever since, even today; and had threatened me with physical harms.  I am afraid to go back to the Silicon Valley.  It would be like an American woman going into the Islamic Extremist infected Middle East.  These males from Asia as well some Americans (of all colors and races, particularly older generation males) wanted me to know this is still a man’s world.  

 

Even my father didn’t believe women should be educated (typical of Asian male), and wanted me to get a job after High School.  When he learned I was going for a Master’s degree and a PhD, he vehemently against it and threatened me with horrific stories (now I see why).    But since I’ve been self-sufficient ever since High School, had worked 3 jobs in the summer, and we are in America, I didn’t care what he said.  Who knew the SF Bay Area/Silicon Valley became a new Asia that keep women down.  USPTO (the agency, aka the sweat-shop/FoxConn) apparently is becoming a place of keeping women down, from what I had experienced.  You see why I had to keep low key and not be seen? 

 

Furthermore, I have a Master's degree in Electrical Engineering, as an adjunct, research background in Applied Physics and published paper,  I am one of the few fully qualified as a Patent Examiner, as well fully grasped the concept of patents evidenced by my first case as an air-tight case.

 

Why changed from 2 to a 1, I suddenly lost all my technical know-hows?   This is to play on stereotypical of conventional beliefs that women are weak in the technical field, as a way to set me up for my eventual termination.  That is to say, Paul Rodrigues already planned my termination as far back as the Training Academy, even after I talked to him extensively on most of my patent cases and shown in-depth technical knowledge.  This is a clear sign of discrimination toward me as a Chinese-American and a female.

 

i.        I was summon to see Wendy Gerber by Paul Rodrigues on the 6th month Evaluation cited if I don’t improved,  I will be terminated.  This is a threat, an abuse toward me as a Chinese and a female, the resulted of such threat was I had to work 24/7.  My Productivity was at 41%, on par if not better than most in AU2123 and AU2128 on their 6th month Evaluation.  This was a confirmation that I was setting up to be terminated.  Another example of setting me up to be terminated as the result of discrimination toward me as a Chinese and a female.     

 

I would have done better than 41% had I not transferred from AU2128 to AU2123 because David Silver and I began to get in-sync working together.  After I transferred to AU2123, I had to get used to how Paul Rodriguez wanted things done, but still outperformed most in this Unit/Class at 41%.

 

j.        In my shared office with Hung Havan, I asked Nathan Hillery whether my 6th month Evaluation at 41% on par with others on their 6th month Evaluation, he said no.  Nathan and Hung exchanged a look with disbelieved, which I overheard Nathan said to Hung on his way out “she’s at 41% already?”   I also let my officemate Hung Havan aware of this meeting to see what remedy he has.  I believed this is when Nathan Hillery and Hung Havan started actively plotted for my termination using defamation because both realized a woman is outperforming them, and they may not have a job in the near future.  Hung Havan also make a comment “nowadays women are smarter than men” to Nathan Hillery, as well said his sister and wife is doing better than him as a Patent Examiner.

 

Now think about that, neophytes on our first year probation shown exceptional achievements is a threat to job security of low performers such as Nathan, Hung and Michele.  Women like me are an easy target for these low performer psychopaths such as Hung Havan, Nathan Hillery, Michele Choi, PETER D COUGHLAN, and Susanne Lo’s friends-from-India.  But male top performers in my lab class such a Shawn Joseph, Reza Nabi, and Daeoo Lee were promoted, indicative of discriminations toward women.

 

k.      Compare my performance to all previous AU2123 and AU2128 at their 8th month evaluation; I am still one of the top performers.  Yet I am terminated to keep Chinese women down.

 

l.        I believed this is the reason why so many in this AU 2128 slandered and maligned me from the beginning - a woman is outperforming them.  This is evidenced by Susanne Lo’s friends-from-India; also my officemate Hung Havan – a male, who was also part of the AU2128, joined the coterie of Susanne Lo and friends-from-India later.  This coterie typically congregated either in our office or Susanne Lo’s friends-from-India’s old office in the 5th floor frequently, to defame others mainly such as me to incite resentments toward me and subject me to harassments, and to finally terminate.  They did a very good job as you all terminated me even though I worked nearly 24/7.  Dwin Craig aware of this and knows their names as their office is near Dwin.  I don’t know when they found time to work.  Maybe that’s why Hung Havan had been at the verge of being terminated for as long as his tenure with the USPTO, but instead, I am terminated.  This is indicative of discrimination toward women. 

 

m.    Since Dwin Craig’s office is in close proximity to Susanne Lo’s friends-from-India, it is most likely that Dwin Craig been incited/radicalized by their slanders, and may very well been used as their tools to do their dirty deeds for them to terminate me.

 

How would one such as Dwin Craig been radicalized/incited, one might ask?  Let’s say Dwin had certain resentments toward Asian women, and he might not like the likes of Susanne Lo, Michele Choi, etc, for some reason; so when he saw me, he assumed I must be one of them and took it out on me, before I become a permanent employee.  And/or that Dwin might hold a grudge against certain individuals such as Bill (in charge of COPA.  I knew Bill as in Classification (the Classification guy)), and now he heard the slanders by Nathan Hillery and Hung Havan who were radicalized/incited by Susanne Lo’s friends-from-India, accused Bill of played favoritism toward me.  Well, this is just perfect for Dwin, kill 2 birds with one stone.  

 

As a note, I worked nearly 24/7 as evidenced by my computer log time, and the only time I spoke to Bill was when Hung and/or Nathan was/were there, which is less than 15 times, and typically a few sentences as I had to get my cases done, hence the 93% Productivity.

 

You see how slanders incited and radicalized others to act?  Especially those with hidden feral streak psychopaths such as Hung Havan, Nathan Hillery, Michele Choi and Dwin Craig incited and radicalized by Susanne Lo’s friends-from-India.

 

n.      Hung Havan, Nathan Hillery, Michele Choi and Susanne Lo’s friends-from-India’s performance  are nowhere near mine at their 8th month evaluation, and Hung Havan is still couldn’t perform at full GS-9 level, yet I am terminated.  Another example of eliminating top women performer as a way to keep women down.

 

o.      Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen, Hung Havan slandered and vilified me because “women smarter than us are analogous to slapping us on the face”.  This is not just discrimination toward women, but also created a hostile working environment for women top performers and sexual harassment toward women.

 

p.      Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen, Shawn Joseph, Hung Havan, Michele Choi and Nathan Hillery incited sexual harassment toward women such as me; with Reza Nabi as a willful participant, with comments such as “she likes to look; she needed a man” as if they are Fabio.  Their intention is to degrade women by having every lowlife to sexually harass and abuse women such as me to show me this is still a man’s world.  This is the resulted of their discrimination toward women, particularly those who they believed as “smart” as a way to keep women down.  On my defense, I needed a man as much as I needed a disease.  Look what they’ve done to me.  They’ve ruined everything that took my whole life to build, ensured I can’t secured a job, fired soon if I did-I am terminated as the resulted of their doing, while continuously being sexually harass and abuse everywhere I go; just because I am an Americanized Asian woman outperformed them in jobs. 

 

q.      Hung Havan- my officemate told me he didn’t like Kamini Shah, Susanne Lo and Wendy Gerber at various occasion.  I knew it is motivated by the fact he does not like women to be more competent than him.  I make sure not to let him or any Asian male feel I am more competent than them in anyway; hence my low key and not be seen.  Unfortunately, he found out via PALM when I done 3 cases per bi-week and Productivity at +- 100%; which he told others such as Michele Choi, his friend who have a history of defaming everybody she knows to everyone in the 4th floor and everyone she talks to, to incite envy and jealousy toward me.  Hung Havan also joined Susanne Lo’s friends-from-India and Nathan Hillery coterie in a concerted effort to terminate me, and with the help of Michele Choi, they actively incited sexual harassments and abuses toward me that resulted in my bi-weekly Productivity dropped from 103% to 50%. 

 

Few weeks before my termination, I overheard Hung told Susanne Lo that I am going to be married with Bill (in charge of COPA) soon, whom I only spoken to a few times.  This is just another one of Hung Havan’s defamation of me as the result of his deep-seated hatreds toward women outperformed him. 

 

Discrimination against women is still alive and well today in our society, even in our government.  Take the Congressional hearing on women’s health where the panel composed of entirely of men, and excommunicated the one and only woman that was on the panel. 

 

r.        The only fair way of comparing my Productivity performance is by comparing with people from the same Class/Art Unit (2123 and 2128) in their 8th month evaluation, in addition to whether they have an air-tight first case or not.  To compare with other Art Unit would be analogous of comparing apples and oranges.  Case in point, in AU2123, one of the patent cases I examined was on an atomic probe which scanned for the atomic shape as well the forces (electromagnetic as well gravitational forces) that broke Quantum Mechanic 101 law – introduced an external element changes the state of specimen under test.  (This patent would be the building block of a Transporter from Star Trek if anyone is going to build one, and will.)  Compare this to my other Art Unit cases where one, for example, a patent on the collage of icons, their border, the size and shape of the icons, similar to the display on iPhone.  Need I say more?  According to the Agency’s management, these 2 cases take the same amount of time to finish.  That’s why Class 703 of Art Unit 2123 and Art Unit 2128 been problematic for such a long time.  And yet my performance is measure again Class 715, and not within my Class 703 or AU2123.

 

s.       There should be an investigation on all previous terminations by Paul Rodrigues as he had a weak technical understanding of AU2123 – Simulation, Emulation and Modeling.  Also talk to examiners under him such as Jason Proctors- a Primary.  Kamini Shah, David Silver and Jason Proctors who I worked very well with, have a good understanding of the their Arts.  I believed Paul Rodrigues is in over his head on AU2123 technology.  The fact that he confined me to use only USPTO’s search engine, no Google, Yahoo or other commercial search engine, shown Paul either doesn’t know patent requirements or intentionally gave me a hard time to set me up for mine eventual termination.  I used all search tools that resulted in an air-tight case as my first case.  Also should look into the percentage of women terminated by Paul Rodrigues.

 

Now, unless someone had worked in the High Tech industry, very few people could completely grasped the concept of AU2123 and AU2128 – Simulation, Emulation and Modeling; particularly Emulation, which even those worked in the industry took years to fully grasped the concept.  Thus, I typically give people a break on this and tried to explain in details how everything works, even with Paul Rodrigues.

 

Consider the level of difficulty of the Art of AU2123 and AU2128; it is completely puzzling to me why TC2100 set the hours-to-complete-a-case at ~36hrs, on par with other Art such as Class 715, as if management has no understanding of their Arts (field, technology). 

 

t.        PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE) from the Artificial Intelligent Art Unit 2122, a BIG Caucasian guy whose office is in close proximity to my office, had been going around slandered me saying “she is a dyke”, etc .  One such person I overheard PETER D COUGHLAN slandered me to is Omar FERNANDEZ across the hall from my office, an Artificial Intelligent Art Unit Primary.  This is an obvious sign of discrimination toward women, also motivated by discrimination toward me as a woman and Chinese.  He has the tendency to roam the hallway.  I ran into him a few times and greeted him cordially.  You see why I had to stay in my office/cube all the time? 

u.      PETER D COUGHLAN and Dwin Craig both had asked me whether I am married; the first time an old guy asked me, I thought that was rude.  Now after a few others like PETER D COUGHLAN and Dwin had asked me, I wondered if this is the culture here?  This is indicative of discrimination toward women.

 

v.      I ran into PETER D COUGHLAN nearly every morning and on my first day at 7:30am for a month plus when I just moved into my new office.  How did he know I arrived in my office at 7:30am is beyond me; however, I never seen him so early in the morning on a daily bases, except occasionally in the Pantry after the 1st month or so.   He said to me “early bird catches the worm”, “he is divorced”, that “I am vain” while commenting on his unappealing appearance, as if he doesn’t like good looking women.  I have no idea what he meant; surely he didn’t mean to date me, which would be creepy as his world view is of my grandfather’s generation.  PETER D COUGHLAN also said to me that he had found a woman to replace me and not interested in me anymore, when I saw him talking to another woman on the hallway next to the Men’s bathroom near the elevator.  I was on my way to the Pantry.  I show no interested in Dwin, PETER D COUGHLAN or anyone for that matter, only interested in friendship toward decent human beings, to be part of my support group.  I have no time for anything as I worked nearly 24/7 and completely entrenched in my work, hence worked nearly 24/7 and 93% Productivity.  As it seems, this kind of sexual advances is very common with PETER D COUGHLAN or Dwin, and I would not be surprised if this is one of the reasons they terminated me.  I also believed Dwin and PETER D COUGHLAN had done the same to other women who refused their sexual advances by checking all previous termination they involved in, as well women terminated in their Art Units.

 

I found these old guys to be very scary, they seem to be so desperate to find a woman they are liable to do anything if they don’t get what they want.  Why did they want to hurt me?  This is why I stayed low key and not be seen.

 

w.    On at least 2 occasions, Dwin Craig makes obscene body gesture by moving his hip back and forth over and over again while talking to me in my office, while Susanne Lo’s Indian friends were smirking; Michele Choi was there as well.  I make a comment to Michele Choi that I needed her there to protect me from this.  I was still getting to know people at this point, not realized my officemate’s friend Michele Choi hated women outperformed her.  Who knew Michele Choi and Hung Havan are so vile that set me up to be sexually harassed later using their smartphone/Iphone.  Michele Choi defamed me to Hung Havan and everyone she talked to since I moved into the office.   This is the kind of psychopaths you have working here.    This is the kind of sexual harassment that makes me afraid to be near people or leave my office and caused my Productivity performance dropped from +-103% to +-50%.

 

x.      I ran into PETER D COUGHLAN on the hallway outside of his Artificial Intelligent SPE Kakali Chaki’s office, he said this area is the vortex of evil, I said shouldn’t that be vertex?  He exploded and yelled at me suddenly, a sign of abusive behavior toward woman.

 

y.      There seems to be a concerted effort by the likes of PETER D COUGHLAN and Dwin Craig to get people terminated as a way for them to feel and shown power as well in control (aka megalomaniac syndrome), particularly people like me – an Asian and a woman who they perceived as lesser of a human, who is not interested in their sexual advances - how dare someone like me refused them.  This is very common in a dysfunctional society, particularly in a working environment.  I believed they had the ears of a top level management (a woman, above Wendy Gerber) that Paul Rodriguez referred to in my termination who was the one responsible for my termination.  USPTO allowed these people to influence the termination of people like me who just wanted to do a good job, and you wondered why you can’t find and retained qualified candidates with ~75% TC2100 new hired drop-out rate? 

 

These top level managements not looking to improve working condition with such glaring red flag of ~75% new hired drop-out rate in many Technology Centers, not just TC2100; but instead, spend time on listening to reprobates/bigots who are the root of the problems and found reasons to shunned/terminated Chinese and women like me who just wanted to do a good job.  Their discriminatory practices and incompetency had created great pains and suffering for many and me. 

 

Both PETER D COUGHLAN’s and Dwin’s discriminatory practices toward women had caused my Productivity performance dropped from +-103% to +-50%.

 

z.       Top performers are a threat to low performers’ job security, bonus and promotion, particularly to people-from-Asia such as Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen, Hung Havan and Michele Choi, Nathan Hillery, Dwin Craig and Pete (of AU2122 with Kakali Chaki as SPE); and are systemically being targeted and terminated here in DC as well in the Silicon Valley.  Women like me, a Chinese and on my first year probation, are an easy target for low performers.

 

aa.   Even with my background of a Master’s in EE, research in Applied Physics, and extensive industry experiences in Simulation, Emulation and Modeling that resulted in an air-tight first case, I still had to work 24/7 in order to meet 100% Productivity performance, or else we are face with the threat of termination; evidenced by TC2100/AU2123/AU2128 new hired drop-out rate at ~75%, mostly women.  I believed other TCs have similar new hired drop-out rate.   Albert Einstein was once a Patent Examiner; this is how challenging this job is.   Class 703 required a PhD level researcher skills and knowledge to do the job; GUI  (Class 715) needed at least a college degree in Computer Science or Electrical Engineering.  AI (Artificial Intelligence) Class required at least a Master’s degree in Computer Science.  This is a form of abuse toward employees.  This place treated their employees like FoxConn.  This is an incompetency of top level management problem not understanding what it takes to do the job that resulted in such atrocious abuses toward their employees.  There should be a class action lawsuit on this.

 

bb.  Michael Salley- an EEO counselor said he spoke to Paul Rodrigues, where Paul said my termination was based on consensus.  Now since I spent nearly 24/7 working as evidenced by my computer log time, and deliberately kept low key and not be seen:

                                                  i.      How do these people even know that I am alive?

                                                ii.      Who are these people that Paul’s consensus based on?

                                              iii.      If they don’t know me, why such resentment toward me? 

                                              iv.      Most, if not all these consensus people at one point or another were a Patent Examiner, why didn’t they see all the flaws on reasoning to terminate me?  Unless is deliberately ignored.

                                                v.      Their consensus is to discriminate against me as a Chinese and female who is a top performer as a way to keep women down. 

                                              vi.      They wanted me to know this is still a men’s world.

                                            vii.      An easy target for them as I am a Chinese and female. 

                                          viii.      This consensus to terminate me is a concerted effort to abuse me as a Chinese and female.

                                              ix.      Male top performers in my lab class such a Shawn Joseph, Reza Nabi, and Daeoo Lee were promoted, I am terminated, a female.  Interestingly, Shawn Joseph and Reza Nabi actively participated in the slandering of me as the resulted of discriminations toward women.

      USPTO (the agency) put these people in the position of power to terminate me. 

 

cc.   The fact that such a haste to terminate me, a woman top performer, before I become a permanent employee, is a concerted effort to keep women down. 

 

 

3.     Discrimination based on national origin – in my case, being a Chinese-American perceived as Americanized by people-from-Asia.   

 

       

Attacks on me by people I had never met in my life such as Tuan Nguyen and Susanne Lo’s friends-from-India started a month or 2 after I started in the Training Academy, by Tuan Nguyen and his countrymen.  Tuan Nguyen incited unstable and pernicious classmates such as Shawn Joseph, Reza Nabi, Randy Shaffer, Ji (Primary Trainer, Paul Rodrigues’ assistant) who discriminated against women outperform them to either shun me, defamed me, or hostile toward me.  Shawn Joseph in term promulgated such defamation to all the Nov. 8 2010 lab classes. 

 

Witness to defamation by Tuan Nguyen Shawn Joseph, Reza Nabi, Randy Shaffer, Ji were my Lab 2 class - Angie Badawi;  Daeoo Lee; Conrad Pack; Jung-Mu (Jessica) T  Chuang; Nathan Shrewsbury; Peter Thompson; Aaron Johnson; Claudia Dragoescu.  There was a luncheon with Paul in the Academy where many of the lab 2 participated, I and a few others didn’t.  I believed this is when Tuan Nguyen, Shawn Joseph, Reza Nabi, Angie Badawi and others defamed me to Paul Rodriguez. 

 

Chuang Jung-Mu (Jessica) T had heard most of the defamation toward me by Lab 2 classmates, particularly by Tuan Nguyen.

 

To incited resentments toward me from their countrymen/women, Tuan Nguyen and Susanne Lo’s friends-from-India would say “she is too smart”; “she’s going to take your job”;  “she is an American”; “she thinks she’s an American”; “she is rich”, etc;  in addition to “no one liked her, no one wanted her; she needed a man, etc”; where ” she needed a man” and similar mainly to incite sexual harassment and abuses toward women such as me.  I needed a man as much as I needed a disease.

 

Of course, unless Shawn Joseph, Reza Nabi, Randy Shaffer, and Ji are also the instigators of discriminations toward me as a Chinese and a woman.

 

After I joined the Art Unit, Susanne Lo’s friends-from-India begun targeting me, then promulgated all over the USPTO by unstable and pernicious individuals who hated women outperformed them such as Hung Havan, Nathan Hillery, Michele Choi, etc., and finally I was terminated. 

 

Of course, if Hung Havan and Nathan Hillery were not incited by Susanne Lo’s friends-from-India, than they are the instigators of discrimination and hatreds towards me.

 

A smear campaign against me the first month I started the job by people-from-Asia such as Tuan Nguyen and Susanne Lo’s friends-from-India as well other males from Asia in the AU2128 soon after I joined the Art Unit.  They went around saying they don’t like me, or “no one liked her, no one wanted her, she needed a man, etc”; I either had never met them or barely spoken to them.  This is as perplexing to me as why 911 terrorists hated and wanted to destroy Americans.  This statement is no different than Islamic Extremists’ sentiment toward Americans; or KKK’s sentiment toward African-Americans and minorities, motivated purely by bigotries and hatreds.  Their objective is to incite people to sexually harass and abuse me, to finally terminate me.  This is also a way to eliminate competition, not just out of discriminations.

 

This is the same phenomenon as some African-Americans refused to vote for President Obama back in 2008 cited he is not black enough; George Allen’s “Macaca” toward Asian or the same racism toward Asians as I moved around the neighborhood.  In my case, I am not Asian enough for the people-from-Asia, but in a more pervasive way as in the KKK era.  Tuan Nguyen, Susanne Lo’s friends-from-India and their countrymen are the Asian version of the KKK.     

 

Discriminated for being Americanized is nothing new.  All new immigrants from Europe practiced such discriminatory practices toward their Americanized countrymen in the 1800s, then by immigrants from South America.  As a matter of fact, the term “Americanized” was taught to me by a Hispanic/Latino neighbor when I told her about how the people from Asia been targeted me.  And now people from Asia as they are the current mass immigration.

 

The way people-from-Asia been attacking me is the same way Danny Chen “hazed” to death of by his fellow soldiers because he is Chinese, where I am targeted for being Americanized Chinese which people-from-Asia perceived me as a traitor.  All these soldiers understood each other without saying a word when they hazed Danny Chen, just as people-from-Asia understood each other when they targeted me without saying a word. 

 

So far, their slanders of me “no one liked her; no one wanted her; she liked to check man out (to degrade women while flattered themselves); good looking women had it easy or get all the helps, men love to help them, etc” worked remarkably well.  People just believed without question and helped promulgated even though I had never met these people in my life.  Which prompted the question of why would any decent human being or you promulgated an unsubstantiated insidious rumor?  Also, when I was one of the few, if not the only woman in the whole engineering department in the Silicon Valley, why would I wanted to check these smelly guys out when most hadn’t taken a bath for months, surfed porn in groups in their cubicle openly and often, and never stop bad mouthing me behind my back?  In addition, if someone said to you your co-worker had it easy or gets all the helps, and is doing very well, how do you feel?  You would hate that co-worker and wanted to hurt her, especially when you are not doing very well.  Furthermore, if someone with some level of commonsense, one would ask:  if no one wanted her or liked her, why would you talked about her obsessively?    

 

These people created a hostile working environment and sexual harassment toward me because they discriminated against me as a Chinese-American who they perceived as Americanized.  The way they identified me as Americanized in the same way as people identified gay, by appearance and demeanor.

 

 

This kind of attacks/slanders on me by people-from-Asia also occurred a month or 2 after I started my first job in the Silicon Valley/SF Bay Area in the 1990s as well, when people-from-Asia (mainly H1Bs) becoming the majority in the Silicon Valley.  

 

Similar practiced in the SF Bay Area/Silicon Valley where I was discriminated and targeted by people-from-Asia who perceived me as Americanized, because I had none-Asian friends, dating a none-Asian which they degraded both of us by saying I was checking them out and needed a man; people-from-Asia expected Asian women to be submissive and acquiescent, but everything about me is different from them, nor did I shared their anti-American/West sentiments.  In addition, the more people liked me, the worse the slanders such as “no one wanted her; no one liked her, etc”, especially when well-liked by none-Asians and praised by managements.  This is why I had to stay low key and not be seen. 

 

Note that people-from-Asia are a majority in SF Bay Area/Silicon Valley.  Most came from countries where their culture have a history of anti-West, or taught anti-West ideology in school, and with deep-rooted xenophobic cultures; even as advanced as Japan…..still an extremely xenophobic society. 

 

They were the majority in every company I’ve worked in the Silicon Valley; often there were less than a hand full of none-Asians in the whole engineering department of over a 100 engineers, and I was one of the few women, if not the only woman in the whole engineering department.  The reason for such attacks is mainly because they perceived me as Americanized and a female who outperformed them. 

 

Also, H1B holders have to have a job in order to stay in the US.  When none of them could compete with me - a woman, for American jobs; what do you suppose they would do to me when in their cultures, “women smarter than them is the equivalent of slapping on the face”, where women is seen as a slave class to pour boiling cooking oil on if they pleased?  Also, women are bought and sold like live stocks.  Don’t forget, they are the majority in the SF Bay Area/Silicon Valley, and highly influential in the Tech industry, obviously in the USPTO as well considering how fast (9 months) they were able to terminate me.  If they were to compete with me for a job in Apple, Google, Facebook or any tech job for that matter, I would be more qualified and hired.  Without me competing with them, they were hired with these companies going or gone IPO that make them millionaires while I am unemployed and subjected to sexual harassments and abuses everywhere I go as the resulted of their smear campaign since the late 1990s.  This is how I ended up in USPTO; and just like when I was in the Silicon Valley, I am targeted as soon I arrived in DC by people from Asia.

 

Please keep in mind that Asia only been opened-up to the rest of the world not long ago; at best they are as comfortable to people different from them as Rednecks, if you remember George Allen’s   “Macaca” moment.  You can’t imagine the kind of ignorant hillbilly I have to deal with in day to day bases as an Asian everywhere I go, included in the DC area.  If we taught not to discriminate in school, laws to prevent discriminations, and diversity training in every American company, yet we still have people like George Allen.  What do you supposed people came from countries where anti-America/West ideology taught in school do to people different from them such as me?

 

We cannot assume we understand the people-from-Asia using our Western experiences and culture, unless we had lived in Asia for years and know their culture.  We don’t discriminated against them don’t mean they don’t discriminated against us!

 

But because Americans are not yet aware other societies and cultures are equally or worse in discriminatory practices as America was in the KKK era or the current Islamic extremists, which allowed themselves to use as cheap tools to help to ruin everything that took my whole life to build, who people-from-Asia perceived as Americanized, and a woman who they think is “smarter than them, which is the equivalent of slapping them on the face.”  Similar discriminatory practices, sexual harassments and abuses on me since 1998 in the SF Bay Area/Silicon Valley where they were 70%-98% of the engineering department where sexual harassment and abuses happened on a daily bases, than the Tech industry, and now here at the USPTO where they are just a small percentage.  Hung Havan, Michele Choi, Tuan Nguyen and his countrymen, and Susanne Lo’s friends-from-India and their countrymen are exemplary of the kind of people came after me, and their methods of targeted me relentlessly everywhere I go using word of mouth and social networking are textbook tactics since 1998. 

 

Calling these people-from-Asia ruthless does not begun to describe them considering their objective is to ensure I can’t secured a job anywhere, fired soon if I did - as with this job, while being sexually harassed and abused everywhere I go (as evidenced by the hostile working environment and sexual harassment in the USPTO).  It is a slow psychological torture (think about that, hence the Islamic extremists and KKK comparison).

 

Similar sexual harassment and abuses, to finally terminated had been done to me as well in the SF Bay Area/Silicon Valley that incited by people-from-Asia, mainly Chinese, Vietnamese and Indian, where I had even more pronounced accomplishments than the USPTO at Productivity performance at 93%, an ideal logarithmic upward trend performance, and I may be the first woman in this Unit/Class/TC have an air-tight first case.

 

When the likes of Tuan Nguyen, Susanne Lo’s friends-from-India and their countrymen attacked me in NYC, and as soon I arrived here in Washington DC and in SF Bay Area/Silicon Valley, it is no longer just a few people gone rogued; it is called a movement, akin to the Arab Spring and Occupy Wall Street; where social media played an integral part.  When we ignored signs like this, 911 happened, and now the collapse of Middle East totalitarian states such as Egypt, Libra, etc.  This is a danger to American workers and corporations/institutions, especially Chinese-American women such as me (low hanging fruit and a canary in the coalmine), apparently.

 

I mostly wanted Americans and companies to be aware this is going on within their society.  You don’t want this to be a different form of Nazi movement against Americans/West, when considered their fervor resentments toward the West.   There is a reason why I compared to the Nazi movement, if you remember how the Nazi movement started.  Additionally, the extreme hatreds toward women as evidenced by the gang raped and using metal pipe that killed a medical woman student in New Delhi that provoked a nationwide protest, can you afford not to believe me?

 

4.     Hostile working environment and sexual harassments due to discriminations.

Some background of me:

I spent nearly 24/7 in front of my computer working on patent cases, as evidenced by my computer log time.  No one should even know I am alive, by design to avoid being a target of a smear campaign by people-from-Asia, also to avoid sexual harassment.  I just wanted to do a good job for those seeking a patent for their innovation.  I used to work in the Silicon Valley/Tech industry where patent is an integral way to protect our ideas.  Additionally, I wanted to get to GS12 level to be a Primary as soon as possible such to be able to telework and get away from this cesspool; that’s included changing Art Unit if necessary where I would be more productive and better opportunities to advance.  The USPTO should allow their employees to move around where they are most productive, and to avoid racist/bigot SPE or officemate from hell.  It is counterproductive not to do so with such backlog. 

I moved here 2 days prior to my first day on Nov. 8, 2010, hadn’t see daylight for months since I started the job.  In addition, I had never been in the DC area, therefore no one should know I am alive in the USPTO (the agency); with the exception of the people near my office, AU2128 and AU2123, or my lab class from the Training Academy.  But since I kept low key and tried not be seen, barely speaks to people after realized is a toxic environment, such to avoid being notice and targeted. 

I got along with all the SPE Trainers in the Academy from Kamini Shah, Albert Decady, and Paul Rodriguez.  All the Primaries (David Silver and Jason Procter) who reviewed my cases seem to be ok with me. 

 

For those who said they don’t like me.  I either had never met them or barely spoken to them.  This statement is no different than Islamic Extremists’ sentiment toward Americans; or KKK’s sentiment toward African-Americans; motivated purely by bigotries and hatreds.  And this kind of bigotries and hatreds are being practiced widely in the USPTO, as evidenced by hostile working environment and sexual harassment toward me.

 

I realized how toxic the USPTO environment was when slanders and maligns already begun the 1st month I was in the Training Academy.  During one of the  class session, we all gather in front of the class room, Randy Shaffer said to me that Tuan Nguyen told him that I wouldn’t like someone like Randy Shaffer, a farmer from a country side.  At the time, I didn’t even know who Tuan Nguyen was until Randy pointed him out to me.  I said to Randy that farmers are the backbone of our country and an important component to our economy, we should be appreciative of people who worked hard, didn’t steal or rob for a living.  This is when I realized these people-from-Asia are no different than those I worked with in the Silicon Valley.  I tried to keep low key and not be seen since. 

 

The likes of Tuan Nguyen and his countrymen set a bad precedent of defamed me that followed by Shawn Joseph, Randy Shaffer, Reza Nabi, and other lab 2 classmates, which is the source of a cesspool.  No one notice me prior to Tuan Nguyen and his countrymen defamations of me, as well Shawn Joseph’s defamation of me. 

 

As time progresses, defamations such as Paul Rodriguez, the SPE Trainer played favoritism toward women, and only liked to talk and help women; or that good looking woman had it easy because guys like to help them, etc., beginning to promulgate the class; in reference to me talked to Paul about patent cases; to which I had to keep a distance such not to create resentment toward either one of us.  If I didn’t stop talking to Paul, the next slander would be to accuse Paul and I having an affair.  I knew this because similar accusations had been made toward me when I worked in the Silicon Valley, by people-from-Asia; just like America in the Dark Age when witch-hunt was practiced.

 

Talking to Paul extensively about patent cases may have shown the depth of my technical knowledge.  I think this is when some of my classmates with technical background realized the depth of my technical knowledge; hence it may have triggered their competitive edge.  Also cited by Simon (aka Peng Ke) - a Primary assistant to Paul Rodriguez, that he couldn’t believe how much I know in technology.  It is easy to incite resentments toward me at this point by malevolent individuals. 

 

Also, I got along with all the SPE Trainers from Kamini Shah, Albert Decady to Paul Rodriguez, as seen by the whole lab class.  Some got jealous such as Shawn Joseph, Tuan Nguyen, Randy Shaffer, Reza Nabi, etc, who had resentments toward women, are prone to do harms to me at this point.

 

At the first working group gathering within our Lab 2 class, we were divided into 2 working groups.  When I tried to join the group, Shawn Joseph deliberately shunned me from the group, ignored me and speaks over me while I was talking, while the rest of the group, only males at the time, went along as well and shunned me, they were Tuan Nguyen, Reza Nabi and Daeoo Lee.  The other female wasn’t there at the time, which joined the group much later. 

 

Shawn Joseph slandered me with Paul Rodriguez stated “she is a loner”, “no one liked her”, etc., after the first working group gathering.  I believed Paul may have been deeply influenced by those slanders.  Shawn went further and spread to other lab classes within the same Nov. 8 2011 training academy, to smear me with “no one liked her; no one wanted her” etc.    Remember, I just moved here a month or so ago, never met any of these people in my life prior to this. 

 

Shawn’s action may be radicalized by Tuan Nguyen initially, just as many other lab classmates such as Randy Shaffer, simply by saying “no one liked her”, “Paul only likes to help women or good looking women” or “good looking women had it easy” to create resentments toward his target such as me.  No one even bothered to ask why, since I never met Tuan Nguyen in my life prior to this, and spoken to about one or 2 words.  This is the resulted of deep-seated hatreds toward Americanized Chinese-American woman.    

 

At this early period in Training, everyone in this lab class just beginning to get to know each other.  It only takes one person to create a hostile environment, namely Tuan Nguyen started saying “no one wanted her; no one liked her” to incited resentment toward me, which promulgated by other lab classmates such as Shawn Joseph and Reza Nabi, just like HIV virus spread to the rest of the USPTO.  An axiom “one rotten apple ruined the whole basket” said it all.

 

There was another Primary Trainer name Ji Bae.  I don’t know the correct spelling of his name, but should be easily look-up by checking with the Training Academy of the Nov. 8, 2010 class, Paul Rodrigues’ Training Assistants for a total of 3 weeks.  Ji was nice and civilized the first time I spoke to him; then the next day and after, he was hostile and extremely rude.  On his way home, Tuan deliberately came to my cube to say good-bye which he normally doesn’t, with a smirk on his face.  I believed this is the result of Tuan Nguyen’s slandering remarks such as “guys liked to help women”.  Tuan sat next to Ji’s cube; no one else had spoken to Ji yet. 

 

Tuan Nguyen conversed frequently with his countrymen.  If he was able to incited resentments toward me in our lab class, what kind of resentments he could incite with his countrymen toward me, or vice versa?

 

I heard Reza Nabi said to Randy Shaffer and Tuan Nguyen nearby their cube in the lab class “she’s a woman, and she is too smart” while staring at me.  This basically said it all.  Although discriminations toward women as the primary motive for the likes of Tuan Nguyen, Shawn Joseph, Susanne Lo’s friends-from-India or Hung Havan; but also a way to eliminate competition such they are the one to get to top management.  Women are typically a low-hanging-fruit – easy to pick on.  This is also my first-hand experience when I worked in the Silicon Valley where I was often one of the few, if not the only woman in the whole engineering department where 90%-98% were males and from Asia.   

 

Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen, Shawn Joseph, Hung Havan and Nathan Hillery incited sexual harassment toward women such as me; with Reza Nabi as a willful participant; with comments such as “she likes to look; she needed a man” as if they are Fabio.  I needed a man as much as I needed a disease.  This is the resulted of their discrimination toward women, particularly those who they believed as “smart” to degrade women, as a way to keep women down.   First of all, what brain-dead individual believed such self-aggrandizing comment is just mind boggling, not to mention it is repugnant as this is a way Third World culture punished women, as if they are still in their countries.   This is also why slanders spread so wide and fast like wild fire, many acted on it.  Simpletons would look for anything and interpreted in a way to support such repugnant suggestion.  Secondly, I’ve been sexually harassed so badly in the Silicon Valley incited by exactly the same slanders by their countrymen.  Typically, I was one of the few, if not the only woman in the whole engineering department, the rest were males from Asia with one or two none-Asians.  These people-from-Asia came after me as if Islamic Extremists went after a Jewish woman, with same kinds of fervor hatreds.  I was often afraid to leave my cube.  These people make me sick to stomach, and had to take Sick Leaves.  Third, I make a point of stayed away from people by stayed in my cube or in my office to avoid any sort of unnecessary attention or sexual harassment, particularly from males like Tuan Nguyen who make a point of standing in front of me in class, while I sat in class session. 

 

One incident occurred while I was talking to Reza Nabi in our last training class (~7/2011) together on the topic of:  Amendment Case (?), while Shawn Joseph stood on the side of the cube, and Tuan Nguyen sat next to Reza and between Reza and me.  We were put together as a team.  At the time, I was talking to Reza, who was writing the Amendment for a patent case on the computer.  I sat across the cube from Reza where the class sat; Tuan suddenly stood up and walked toward me in a deliberate manner.  The appearance of Tuan standing up while I sat on the chair make Reza’s face turned red as he knew exactly what that meant.  Shawn’s face turned red as well and in an attempt to do the same as Tuan, which then stop and moved back to where he stood.  I was sick to my stomach as this is how these males from Asia degraded women, especially when an Asian woman dating a none-Asian, as I was in the Silicon Valley.  This is very typical behavior of males from Asia working in the Silicon Valley – set women up as if women are doing a sex act for them; that’s why I stayed in my cube all the time, also didn’t want to see them surfing porn in their cube, which was very common.  And finally, it is also a reflection of what is in one’s mind, and interpreted accordingly.  What do you suppose these three would go around saying about me?  Hence beget more sexual harassment, and so on.

 

Later in the same class, SPE trainers (an old Caucasian male) also started watch me closingly and making obscene sudden moves with his leg and hip, a form of sexual harassment.

 

This is also the kind of sexual harassments and abuses I am scared of; thus I stayed in my office/cube, not talk to people or meet with a group of people precisely because of this kind of setup, which people with feral streaks such as Shawn Joseph, Reza Nabi and SPE Trainer very much willing to go along and promulgated.  Hung Havan, my officemate did the most damages to me when spread such repugnant slanders.

 

For those who flattered themselves by saying I checked them out, it would be the equivalent of accused a Black slave checked out a KKK, a Holocaust Jewish person checked out a Nazi, or a repressed woman in the Middle East about to stone to death checked out an Islamic Extremist;  and the only reason they were saying this was to degraded me as well to incite sexual harassment and abuses toward me because I am a woman who is more competent in the job than them; that’s why I was sick to my stomach that led to so many Sick Leaves, also why I stayed in my office and did not want to be seen

 

Everyone acted normal or unaware of my existence before comments made by pernicious individuals such as Tuan Nguyen, Susanne Lo’s friends-from-India, Shawn Joseph, Hung Havan, Nathan Hillery, Michele Choi or Reza Nabi.  If you wanted to know how Islamic Extremists radicalized Americans, Tuan Nguyen and Susanne Lo’s friends-from-India would be a perfect example.  I’ve been shunned and sexually harassed ever since the 2nd month I started the USPTO’s Training Academy.

 

The question is - why are people paying so much attention to everything I do, every move I make, and watched me closely?  There is a name for people like that, and is called a pervert. 

 

One way I gauged what slanders being said and heard is by their behavior; also many acted on what they heard, which said a lot about the character of the person.  No decent human being would allow such repugnant slanders to be said.  If any of these people have some common sense at all, they see right away it is slandering.  Yet few in the USPTO had done so, what does this say about the people in the USPTO?

 

After I joined the Art Unit, slanders and maligns initially incited by Susanne Lo’s friends-from-India of AU2128 after heard that my first case was an air-tight case, and others from my  AU2128; which been promulgated everywhere since.  Somehow I got transfer out of AU2128 to AU2123 soon after. 

 

Although their primary reason is because “she is a woman, and she is smart”, but their objectives are to eliminate competitions and to ensure they are the one who gets to top management.  I got in their way, apparently.  I had never met Susanne Lo’s friends-from-India in my life prior to AU2128 meeting, or any patent examiner in AU2128.  I don’t even know their names.  Nathan Hillery and my ex-officemate Hung Havan started slandered me after they joined Susanne Lo and friend-from-India’s coterie; another word, Nathan Hillery and Hung Havan radicalized by Susanne Lo’s friends-from-India.  Hung Havan, and Susanne Lo’s friends-from-India shared the same sentiment, mainly that women smarter than them is akin to slapping them on the face, said by one of Susanne Lo’s friends-from-India.  It is also to eliminate competition such to secure top management positions. 

 

There were at least 2 of Hung Havan’s countrymen of over 50 years old came to our office to look for him and looked at me with an unfriendly look as if they know me, which was disturbing to me.

 

One must recognized the kind of insults felt by slapping on the face in other parts of the world and cultures, especially by women who they see as less than slaves in the Dark Age, to fully grasped what this means; which explained why people I had never met in my life hated me like the Islamic Extremists hated America/Americans/Jewish.

 

Hung Havan told me he didn’t like Kamini Shah, Susanne Lo and Wendy Gerber on various occasions; how mean and nasty Kamini and Wendy were when they attempted to terminate him.  I knew Hung intended to incite resentments toward the women because of his discrimination toward women.  I’ve been on the receiving end since college when male Engineering professors told me women are not wired to think technically.  I answered one of my professors with the 2nd highest exam grades.  I said to Hung I knew Kamini from Training, I really like her; and I like Wendy after I met her.  Hung also said Susanne Lo is a lawyer in training, etc.  I kept an open mind.  I didn’t know her, and when I ran into her, she was lukewarm toward me.  For all I know, considering the devious character of Hung, he may incite resentment toward me with Susanne just as Hung incited resentment toward her with me.

 

I told my officemate Hung Havan I have a boyfriend soon after I moved into the shared office.  I also told Michele Choi and PETER D COUGHLAN I have a boyfriend.  I couldn’t believe Hung Havan was so evil as to incite sexual harassments toward me while flattered himself in the process with slanders such as I checked him out….he probably thinks he is Fabio.  The best way to stop this is to mercilessly mock them.    

 

Both Hung Havan and Michele Choi, amount many from Asia knew I hated being sexually harassed and deemed those who did as lowlife, as well I would reported them to the EEO.  So to enforce the notion of I checked out Hung Havan as a way to further the sexual harassment and abuses toward me, he tried to set me up such I come across as if I was checking him up.  For example, he would show me clips of his son on his smartphone placed on the desktop while he stood on the other end of the edge of the desk, someone such as his partner in crime Michele Choi would use her smartphone and recorded from afar as if I was checking Hung when he talked to me and I looked up, for the unsuspected simpleton eyes.  Hung Havan and Michele Choi’s intention was to have every single lowlife to sexually harass and abuse me, a woman who is outperformed them, to finally get me terminated.  Since Michele and Hung are close associates of Bill (in charge of COPA), he may have seen the clips, but I am fairly sure Michele already distributed to everyone she knows in the PTO;  you just need to find out who she talks to, they are mostly people from her Training Academy.

 

Another example is when Michele Choi was talking to me; her eyes kept rolling to Hung’s direction as if she was signaling something, so looked at that direction; which she then said I was checking out Hung.

 

This kind of sexual harassments started by Susanne Lo’s friends-from-India and Tuan Nyugan, promulgated by the likes of Nathan Hillery, Shawn Joseph, Raze Nabi, Randy Shaffer, etc, and reinforced by the likes of Hung Havan, Michele Choi.  And really, how many men don’t like to flatter themselves like this, particularly those unbalance/unstable/psychologically damage ones?  Some people Hung slandered me to are his close associates Michele Choi and Nathan Hillery, they then spread this like HIV virus to all over 4thfloor, 5th floor, their Art Unit, and everyone they talked to.  This reminded me of the Silicon Valley, where I was sexually harassed and abused on a daily bases by people-from-Asia that were the majority.  This just makes me sick to my stomach, as evidenced by my frequent sick leaves during this period, and adversely affected my job performance which dropped from +-100% to +-60%.

 

Michele Choi heard all sorts of slanders about me and others; she also spreads them, as well slandered me and anyone she knows.  She is so hated that when she went to the cafeteria with me, the people worked there warned me about how rotten Michele Choi is, and not to mixed-up with someone like her.  On the elevator, a guy attempted to warn me about her. Michele Choi also told me when she invited to weddings; no one wanted to share a table with her.  As it seem, people feared her and are afraid to offend her probably because they knew she might vilified them as she did to me.  Michele Choi worked hard to earn such hatreds toward herself via her action, not because of a smear campaign as being done to me.  She said I always have a smile on my face as if I don’t have any worry.  This is enough to prompt her to come after me.  She is psychologically unstable and hated by all, also with low performance, yet she is still working here; while I worked 24/7 with 93% productivity, yet I am terminated, another glaring exemplary of keeping top women performer down. 

 

Michele Choi, Hung Havan, Nathan Hillery, Susanne Lo’s friends-from-India hardly do any work, slandered those who do worked, such as me, yet still have a job, and I am terminated even though I worked nearly 24/7.  And top management wondered why such a huge backlog of patent cases.

 

The irony is that I kept low key and not be seen was mainly to avoid being notice by the likes of Michele Choi, Hung Havan, Nathan Hillery, Susanne Lo’s friends-from-India and their countrymen, and Tuan Nyugan and his countrymen, who are with questionable character, psychologically unstable with an illusion of grandeur and full of hatreds toward the world that shared the same psychological profile as Seung-Hui Cho of the Virginia Tech massacre.  A woman such as me outperformed them triggered their deep dark hatreds.  Their venting outlets are to bad mouth me to everyone they know, caused suffering anyway they could, and termination such they are the one have the job, bonus and promotion.

 

Just 2-3 months prior to the day I was terminated, and after Hung Havan joined Nathan Hillery and Susanne Lo’s friends-from-India coterie, Hung said he is on his way up.  This is also around the time he got his new phone.  He constantly tells me his goal in life is to get rich.  Now looking back, it is by stepping on dead bodies; apparently mine, in this case. 

 

Hung Havan invited into Nathan Hillery, Susanne Lo and friends-from-India coterie soon after Hung invited them for cake in our office.  This is when Susanne Lo’s friends-from-India noticed I shared the office with Hung.  They looked surprised first, and then gave me a long stared.

 

Hung Havan and his coterie (Nathan Hillery, Susanne Lo and friends-from-India) typically congregated either in our office or Susanne Lo’s friends-from-India’s office frequently, near Dwin Craig and David Kim’s office.  One had recently moved to an upper floor.  Dwin knows who he is and where he moved to.  I don’t know when they find time to work.  Maybe that’s why Hung Havan been at the verge of being terminated for as long as his tenure with the USPTO.    

 

While Hung Havan and his coterie gossiped in our office, I typically had my headphone on and worked.  Dwin Craig also was there at least twice during their so called “party”.  I had to meet 3 cases per bi-weekly, as indicated by my SPE Paul Rodriguez and the Director Wendy Gerber.  Hung Havan, Nathan Hillery and Susanne Lo’s friends-from-Indian barely performed to their GS level, they are not terminated; yet another glaring discrimination toward top performer woman as a way to keep women down.

 

I was being put in the middle of Susanne Lo’s and her friends-from-India, Hung Havan, Nathan Hillery and their coterie as target in a concerted effort to be terminated, by using defamations to incite/radicalized and manipulated everyone they spoke to, as their tool to terminate me. 

 

Hung Havan checked my Production and progress all the time, and told the likes of Michele Choi, Susanne Lo’s and her friends-from-India and others.  Hung Havan told them I was at 93% Productivity and had done 3 cases per bi-weekly to incite envy and jealousy toward me.  He also misled them into thinking that it only took 3 days for me to do the Amended case, which is not true.   He told those who are not the envy and jealous type that I wasn’t doing well.  Hung Havan’s intention was to create resentment toward me, while still acted like my buddy in front of me. 

 

Weeks before my termination and around the time an AU2123 Examiner gave a party on becoming a Primary; where Susanne Lo’s friends-from-India were invited, along with Dwin Craig, Paul Rodrigues and Jason Procter, as well me.  Also the day AU 2123 got our laptop (an i7 CPU!! Finally something decent to work with), and Jason Procter came to pick up his new laptop.  I believed this is when Susanne Lo’s friends-from-India learned Dwin Craig and Paul Rodrigues were my Primary and SPE and defamed me with them to incite them to terminate me, which Dwin and Paul already prone to do so as explained before.  Aside from asking Paul and Dwin what Susanne Lo and friends-from-India said about me in this party, also ask Jason Procter and others in the party.  Days after this party, Hung Havan suddenly asked me how long will I last here, meaning when I will be terminated.  I said depends on the kind of people we have here; if there are more good people then bad people, I will last; otherwise I won’t last.  He knew then I was in the process of being terminated.   Hung Havan also said romantic relationship is prohibited in the office, I said “yeah, most companies have this policy”.  Days before the party, I overheard Hung Havan told Susanne Lo that Bill (in charge of COPA) and I were going to be married when Susanne Lo inquired about house purchasing with Hung, which was strange to me as I knew Susanne Lo was Bill’s girlfriend, and I told Hung Havan I already have a boyfriend; so I didn’t think much of it, surely nobody is going to believe something as asinine as this, or at least do some fact checking, unless nefarious individuals use this as an excuse to terminate me.  But this is just one example of Hung Havan’s defamation of me, the result of deep-seated hatred toward women outperform him.

 

This party may sealed the faint of my termination as I left early to work on my patent cases as I had to meet 3 cases per bi-week quota.  A few hours later, I brought Michele Choi to the party room to pick up leftover food where we ran into Dwin Craig, he looked mad when he saw me and Michele Choi.  I knew he and Michele Choi had some sort of dispute.  Dwin may think I am a friend of Michele Choi, and believed the continuous character assassination of me by Nathan Hillery, Michele Choi, Hung Havan and Susanne Lo’s friends-from-India, as well many others as the result of the vilification of me; also held a grudge again Bill (in charge of COPA) who Nathan’s coterie misled people into believing Bill and I had some sort of relationship, whom I spoken to only a few times; in addition to Dwin’s bigotry/discrimination toward Chinese women, finally set in the process of terminated me with the help of Nathan, via the top level management, with the consensus of the TC2100 management as the result of misled information mostly from Nathan Hillery, Hung Havan and Michele Choi (all with questionable character and psychologically unstable).  Finalized after spoken to Hung and believed his defamation of me.  Again, I worked nearly 24/7 that resulted in 93% Productivity, hardly leave my office nor did I have the time to talk to anyone.

 

Hung Havan had been texting with someone on his new phone when he asked me many of the questions on different occasions.  He joined Nathan Hillery, Susanne Lo and her friends-from-India coterie around the time he got his new phone.  Hung also used his PC’s Communicator to IMS (message) with his coterie.  USPTO could easily check his PC and phone for details.

Soon after I told Hung Havan that I am going to be terminated, he was on the phone debating with someone whether to tell me “no one wanted her, no one liked her”.  I have no idea this guy is so sadistic, scheming, manipulative and dangerous.  This is probably due to the fact the Michele Choi told Hung “everyone wanted to talk to Mona”.  Hung knew it is true because when he went out with me, same thing happened.  Also, Hung said all his friends liked me, and now became my friends.  I sensed he did not like that, so I kept a distance from his friends such as Erica (office nearby), Tigel(spelling?) a woman from Artificial Intelligent Art Unit 2122, etc.  The last time I spoke to Tigel, she acted differently.  I am sure she heard the slandering of me, mostly from Hung.  She is an ethical person.

 

Nathan Hillery, a POPA Representative, and Michele Choi been slandered me such people would sexually harassed and abused me to finally terminated, to nearly everyone s/he spoke to in the 4th, 5th floor, and GUI (class 715); and now may be in the 10th floor and other floors of Randolph; where Nathan’s close associate moved to - one of Susanne Lo’s friends-from-India.  Dwin Craig and David Kim know who and where they moved to.  Nathan Hillery may be the major player in promulgating slanders and maligns of me throughout the USPTO, I suspect.  In particular, Bill (in charge of COPA) played favoritism toward me; whom I spoken to only a few times.   To clarify, Bill mentioned soon after we met he has a girlfriend and was going to see his girlfriend’s parents over the weekend, so it seems they were very serious.  Bill’s girlfriend is Susanne Lo, and is well-known to this TC.  I believed Bill been tried to get his girlfriend to marry him, included making her jealous.  I also told my officemate Hung Havan soon after I moved into the office that I already have a boyfriend, and to PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE) when he asked whether I am married or not, and later to Michele Choi, amount many others.  Nathan Hillery was very close to Bill and spent nearly every day together.  I spent most of my time working, I care less about anything other than work, as evidenced by my computer log time and 93% Productivity.  I met Bill as well Nathan Hillery because they tried to help my officemate Hung Havan from termination.  I thought Bill was Union.  If Bill was Union, I would have spent the time and befriended him because I have a feeling I was setting up to be terminated; but instead, I tried to befriend Nathan Hillery.  BIG mistake!  Ironically, Hung, Michele Choi and Nathan Hillery plotted to terminate me and succeed; who were incited/radicalized and plotted by Susanne Lo’s friends-from-India. 

 

Nathan Hillery elbowed my chest in a deliberate act few months ago when he passed by me on his way home with Bill (in charge of COPA), in front of my office.  Both didn’t say anything to me.  I told myself my objective here is to get to GS12 and telework.  I bit my lip and went back to work; a dark mark on my lip still remains today.

 

Days before my termination, I ran into Nathan Hillery and his coterie Susanne Lo and her friends-from-India in the 5th floor pantry, outside of Dwin Craig’s office.  He came over to talk to me; I said something like “have you not notice?  I am on my probationary period, the USPTO owned me the first year”.  On his way out with his coterie, I overheard he said “she is his kryptonite”, “she is the weakest link”; I didn’t know what that means.  Also “So my Union Rep. is a Teflon shield, they can’t touch me or fired me as long I am a Union Rep?”  Few days later, I was notified I will be terminated.

 

“So my Union Rep. is a Teflon shield, they can’t touch me or fired me as long I am a Union Rep?” Nathan Hillery said this at least twice to Hung Havan in our office at different time, he knew nothing can be done to him no matter what he did as long he is the Union Rep, included set me up to be terminated.  I am so disgusted with Union.

 

On Aug. 11, 2011, a day before my termination, a SPE from another Technology Center wanted me to join his group, but called by HR of some sort, according to him, and warned him not to get involved.  Now, the only people I disclosed this to were Nathan Hillery and Hung Havan as I was seeking Union help, and Nathan Hillery was a Union Rep for TC 2100, also helped my officemate Hung Havan from termination.  Nathan Hillery asked me who the Director is.  I said I don’t know but gave him the Art Unit.  As soon I said that, Hung Havan searched the computer as he had met this SPE before, and both left the office right away in a conspicuous way without helping me.  Soon after, this SPE from another Art Unit called me and said he couldn’t help me as he can’t afford to lose this job.  Whether this was a real HR phone call or not is questionable, and can easily verified by trace the phone number from this SPE.  This is just another example of a concerted effort by Nathan Hillery and Hung Havan to terminate me.  I believed Nathan Hillery is in love with Bill (in charge of COPA) and have deep-seated hatred toward woman who are doing well as stated previously.

 

Since Hung Havan, Nathan Hillery, Michele Choi and Susanne Lo are close associates of Bill (in charge of COPA); I wondered if this has anything to do with Bill?  I remembered in my past, a protégé of a top technical staff slandered me as a way to eliminate me such I won’t become a close associate of this top technical staff, which this protégé feared I might replace him.  This protégé wanted to have full control of this top technical staff, a way for the protégé to grab power and get ahead; also jealous and envy of the continuous praised and attention I got from this Senior Technical Staff as well others.  Just think, I found the bug that been plagued the design team for months that cost millions and might had to scrap the whole chip design, on my 3rd day on the job.  I was ousted even with continue outstanding accomplishments.  I told this story to Hung Havan a while back.  This protégé shared the same personality and characteristics as Shawn Joseph and Nathan Hillery.

 

One of Susanne Lo’s friends-from-India gave me a body gesture of f@#k-you (whole body movement with an emphasis on hip movement forward/pelvic thrusts in the air like Michael Jackson) toward me near the elevator when I passed him by, with an euphoric and “couldn’t believe this is actually happening” look on his face.  He was talking to David Kim and a new hired of AU2128 at the time.  This was few days before my termination, as if he knew what’s going to happen to me.  I knew something bad is going to happen to me, just didn’t expected to be terminated with all my accomplishments.  This is also the kind of sexual harassments and abuses that I am scared of, which resulted in reluctance to leave my office/cube, not wanted to talk to people or meeting with people.  

 

Tuan Va of AU2193 with an office overlooking the hallway of the Pantry, whom I ran into quite often in the Pantry, I believed he was stalking me.  At one point, every time when I go to the pantry at various time of the day, he followed right behind me.  I had to use the pantry on the other side of the building for a while.  I would check for porn in his computer.  One person Tuan Va might slandered me to is Russell Guill of AU2123 as Russell behaved differently toward me after he spoke to Tuan Va.  I was there at the time, and left soon after.

 

Randy Shaffer make obscure to obscene body movement sexual harassment, as if he is going to have a heart attack, punch someone, or imitated Michael Jackson while talking to me in my office.  I gave Paul Rodrigues a look that said what the hell is he doing.  This last for a while until I got inpatient and moved, then he stopped.  I had to control my muscle spasm disorder such I wouldn’t kick the guy.  I was concerned for my safety, makes me nervous and ready/wanted to run away.  Many other males do that as if is a disease or virus been passed around.  This is obviously the resulted of defamation.  

 

“No one wanted her, no one liked her” is exactly the antithesis of the truth, a common slander tactic practiced by people-from-Asia; this is also a way of saying how stupid their audience are - mainly Americans, as proven by my case. 

 

Even the last 2 old Caucasian male SPE trainers from my last 2 training academy classes were beginning to believe the slanders and started the sexual harassment, which prompted me to question the soundness of the psychological health of these people, included all levels of management who believed anything anybody said, without any basic commonsense whatsoever.  I guessed critical thinking is a prohibited practice in the USPTO.

 

This ubiquitous of people believing anything anybody said reminded me of the children’s story “The Emperor Has No Clothes”, where Susanne Lo’s friends-from-India, Tuan Nyugan, Hung Havan, Nathan Hillery and Michele Choi are the tailors magically gotten all the peasants in the kingdom seeing the emperor’s new clothes.  Hung Havan also kept telling me I am the emperor, meaning Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Nathan Hillery, Michele Choi and him had gotten people to see what they wanted people to see me via a smear campaign. 

 

Hung Havan had tried psychological abused and demeaned me in person, not just using slanders to incite others to do the same.  This is when he learned I was doing 3 cases per bi-weekly and Productivity over 100% from PALM’s Examiner Calculator.  I barked back loud enough for everyone to hear.  Hung Havan had confirmed he has a dark side.   Anyone who sees how much of a psychopath Hung Havan, Michele Choi Tuan Nyugan, and Susanne Lo’s friends-from-India are, it should send chills up his/her spinal; and I’ve been dealing with evils all my life.

 

On my last day when I went to say good-bye to Erica down the hallway from my office, as I walked into her office, Hung Havan stood in front of her office and stretched his arms out in front of my chest and block me from going inside Erica’s office, in term I couldn’t stop on time as it was so sudden, and Hung’s arm hit my chest.  It seems that Hung Havan would blocked me physically from saying good-bye to anyone, so I gave up and went back to my office to send out email instead.  This is the kind of brazenly abusive behaviors Hung Havan had toward me.  Michele Choi also elbowed me to push me out of her way on her way out after she took most of my office supply with her, on my last day.

 

Hung Havan also disclosed to me that he told people I am just like Michele Choi, and said that he didn’t know other woman except Michele Choi.  Well, actually he knows Erica from a few doors down from his office and another woman who came to our office quite often.  The only reason he said I was just like Michele Choi was that Michele Choi has a really bad reputation and is hated by many such as Dwin Craig.  Hung Havan knew I was nowhere similar to Michele Choi other then she claimed she’s from NYC as well.  He was out to ruin me as women who had out performed him.

 

When asked why people slandered and maligned me, or asked “why you don’t like her’, people such as Tuan Nguyen, my officemate Hung Havan or Susanne Lo’s friends-from-India, the answer is typically “she is too smart”.   That is a rather misleading statement led people to believe arrogant is in order, when the truth of the matter is “she is a woman, and she is smart” which to certain culture, “the equivalent of slapping them on the face”; also to eliminate competition such they are the one gets to top management. 

 

People such as Tuan Nguyen, Susanne Lo’s friends-from-India, and Hung Havan are very slick; they make Bill Clinton (slick Willy) looks like a little school boy.  A good example is Hung Havan slandered and vilification of me with everyone he knows behind my back, but still acted like my buddy in front of me…. should be a good indication; also, all these people managed to connive and manipulated the people around them as their tool to terminate me.  In order to find the truth, I would highly recommend someone who is seasoned and well verse in investigative questioning in people like Bernard Madoff. 

 

The investigator needs to ask whether the person questioning has been coached by anyone as to what to disclose, whether by the USPTO, lawyer, supervisor, employee, friends, family or anyone.  They also needed to be informed they are subject to testify under oath, and cross questioning by me.  It is extremely important they are aware I will be cross questioning them.

 

A thorough background check on their credential such as college degree needed to be verified on Nathan Hillery, Shawn Joseph, Raze Nabi, Randy Shaffer, Hung Havan, Michele Choi, Tuan Nygyen and Susanne Lo’s friends-from-india

 

As a note, since slanders and maligns are character assassination to incite resentments toward me, hence it is important not to take what people say literately, but to look at people’s action and my action.  People’s actions are that they spent most of their time gossiping, scheming, conniving, slandering, maligning and sexual harassment toward others such as me.  My actions are that I am in my cube or office working as evidenced by my computer log time, 93% production performance and an air-tight first case.  Action speaks louder than words.

 

The investigation should focus on actions that led to my termination - who did what.  For example, slandered me is an action.  But if you listened to what someone like Hung Havan said, it would akin to listening to Bernard Madoff, you will be conned.

 

Who did what – by analyzing the situation, this is what I think how it happened: The likes of Tuan Nguyen, Susanne Lo’s friends-from-India promulgated slanders such as “no one wanted her, no one liked her, etc” from early on, before anyone knew me, to incite resentments toward me; then promulgated by unstable and pernicious individuals such as Shawn Joseph, Nathan Hillery, Hung Havan, Reza Nabi, Michele Choi, Randy Shaffer etc. Now these unstable and pernicious individuals with deep-seated hatred toward women who out performed them, had been radicalized by Susanne Lo’s friends-from-India and Tuan Nguyen, they further slandered me with everyone they talked to, and some slanders caught on by the likes of Dwin Craig and Paul Rodriguez who may not like Chinese-American women, and may held a grudge against certain individual, thus Dwin and Paul Rodriguez acted on it and put in the process of terminated me, with the help of a Union Rep - Nathan Hillery  I am sure Dwin Craig is not the only one been radicalized by slanders and acted on it to terminate me as it is based on consensus, according to Paul Rodrigues.  It is a consensus to keep top women performer down.  I would not rule out some top level management been radicalized by the slanders as well. 

 

Before my termination decision finalized, at least one person interviewed Hung Havan- my officemate, regarding me, which finalized my termination because of Hung Havan’s defamation of me. The names of these people should be known to Wendy Gerber. These are the people you should talk to as to what and how Hung Havan slandered and defamed me.

 

When and if you talk to Hung Havan, please compared to what he said to my actions; that I spent nearly 24/7 working on patent cases on my computer, as evidenced by my computer log time. Also, I just moved to DC 2 days prior to my 1st day of work on Nov. 8, 2011, and haven’t seen daylight for months since, while deliberately kept low key and not be seen or notice since I cognizant of how toxic the USPTO is; thus, no one should even know I exist or alive. I managed Hung’s feral streak by appeal to his good side as much as I could as I didn’t have much of a choice with him being my officemate, but one may never able to manage deep-seated evil.

 

Nathan Hillery abused his Union Representative position by using his position to terminate me through defamation of me everywhere.  I suspected he is one of the few that pushed this agenda with the USPTO management, using his Union Rep position.  Such grossly abused of a Union Representative position is astonishing, yet POPA seems to be allowing their Representative to run-amok.  POPA needed to investigate this kind of gross abused of power, or this kind of individual will plagued the name of Union.  I am just completely disgusted with the Union. 

 

The consensus to terminate me in such haste is stemmed from - Michele Choi went around the 4th floor where the GUI (Class 715) Art Units located saying “if Mona could do 3 cases per bi-week, it must be easy, I wanted to transfer to GUI too”.  Hence, many in GUI knew I was doing 3 cases per bi-week, included Nathan Hillery who is in GUI.  The GUI people did not want a woman from another Art Unit to perform 3 cases per bi-week, while unable to achieve similar result in her Art Unit where she have an expertise on.  GUI people included Nathan Hillery, don’t wanted people to think GUI art is easy as Michele Choi promulgating all over the USPTO.    I believed this is the real reason behind the consensus to terminate me per Paul Rodrigues when spoke to Michael Salley; in such haste was to keep top performing women down;  in addition to Paul Rodrigues and Dwin Craig don’t like Chinese and female out of discriminations.   This is a problem of top level managements who don’t have technical understanding to know what it takes to do the job in AU2123 and AU2128 Simulation, Emulation and Modeling.  SPEs in AU2123 and AU2128 have to resort to use extraordinary tactics on their Patent Examiners in order to keep up with GUI and other Art Units.

 

The top level managements’ (a woman above Wendy Gerber) decision to terminate me is stemmed from – Dwin Craig and PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE) both see Asian women as a second class citizen, who have the ears of the top level management where they defamed me because their sexual advances toward me were rejected; also a way to secure their job by eliminating top performers.  This top level management discriminated against/resentful toward Chinese/Asian, therefore is susceptible to defamation toward Chinese such as me, and very much willing to terminate me without careful consideration.

 

What is perplexing to me is that why are so many people in the USPTO, even in management, so easily incited by the likes of Nathan Hillery, Hung Havan, Michele Choi, etc, who were radicalized by the likes of Susann Lo’s friends-from-India and Tuan Nguyen?  How safe are women working for the USPTO, or anyone, for that matter? 

 

We live in a globalized world, when companies such as those in the SF Bay Area/Silicon Valley, and the USPTO are not aware of the kind of cultural practices of  people from other parts of the world such as Asia they hired, Chinese-American women like me gets hurt, and had everything took our whole life to build ruined.

 

Meanwhile, guess who is sitting on the sideline enjoyed watching me being sexually harassed, abused and finally fired; and the USPTO’s investigation into who is responsible for wrong-doing?  Basically, everybody got hurt except those (Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Hung Havan, Michele Choi) started all the slandering; and they will be the one got promoted at the end, and I am out of a job, just like in the Silicon Valley.

 

The culture the USPTO fostering is gossipy, slandering and targeting top performers who just wanted to do a good job to be terminated, by the likes of Susanne Lo’s friends-from-India, Tuan Nguyen, Nathan Hillery, Hung Havan, Michele Choi, Shawn Joseph and Reza Nabi. 

 

If you asked Hung Havan, Nathan Hillery, Michele Choi, Susanne Lo and friends from India of AU2128 why they set me up to be fired, they will say they are saving me from an unsavory motive of an individual, which is as megalomaniac as a murderer using an excuse for killing a college senior was to save her from all the suffering of life. So how is conducting a smear campaign against me, using a smartphone to set me up for sexual harassment and raped, and physically blocked me to say good-bye to a co-worker and elbowed me, to save me? They’ve been played everyone like a monkey and been using management as cheap tools to do their dirty deeds of terminated me.

 

What should be disturbing and troublesome to the USPTO and management is that what if Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Nathan Hillery Michele Choi and Hung Havan decided to come after you, to replace management with their own people; or lawsuits from discrimination and/or sexual harassments incited by these people?  You now know they are perfectly capable of replacing management, as well using management as their tool to eliminate top performers such as me.

 

“No one wanted her, no one liked her, etc” slanders are now heard outside of the USPTO as I moved around the neighborhood.  Recently (~2/2012), “she has wondering eyes” ”she liked to check men’s out”, comments meant to have every lowlife to sexually harass and abuse me are make behind my back as I ran my errands in the neighborhood of Alexandria, VA, that’s why I’ve been afraid to go out for fear of sexual harassments and abuses.  So, what are my chances of secured a job with this kind of defamations everywhere I go, originated in the USPTO?

 

As I pass-by the USPTO campus on 6/2012, one of Susanne Lo’s friends-from-India countrymen laughed so hard he couldn’t stand-up straight and pointed to me said “those idiots really fired her”.  Psychopaths such as Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Nathan Hillery, Hung Havan, Michele Choi and PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE) enjoyed watching me being terminated, and are enjoyed watching the investigation of managements.  They are laughing at all of us now, and will be the one with a job, bonus and promotion at the end just like in the Silicon Valley.

 

On 1/30/2013, I was in the Agency’s USPTO Alexandria VA campus for the deposition.  When I went to lunch outside the building where the deposition took place, as PTO employees (Indian/Middle Eastern descent with PTO employee badge) passed by me on the street of John Carlyle street, they were telling their friends "no one wanted her; no one liked her".  And then when I was up in the 9th floor sitting outside of the meeting room waiting for Mr. Levin, Ms. Siehndel and Pat Staffa (Court Reporter); a male employee just turn the corner, saw me there and look down to his private part.  This brought up too much memory of when I was working as a patent examiner working nearly 24/7 tried to meet 3 cases per biweek while being sexually harassed and abused, as well setup by my officemate Hung Havan and his friend Michele Choi using their smartphones to make me come across as if I was checking him out to beget more sexual harassments toward me as well to degrade me, to finally terminated.

 

This whole ordeal (akin to Abu Ghraib, and analogous to the “hazed” to death of Danny Chen by his fellow soldiers) and TC2100/AU2123/AU2128 first year hired drop-out rate at ~75%,  should give USPTO an idea of what kind of people you have working here – unstable and pernicious racist/bigots, and the incompetency of top to down levels of management.  People like Nathan Hillery, Hung Havan, Michele Choi, Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Dwin Craig, Paul Rodrigues, PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE), as well all TC2100 were part of the consensus to terminate me obviously had terminated many others just like me before.  USPTO needed to look into all terminations initiated by these people; otherwise the USPTO is going to be known as the American version of the FoxConn.  Why terminated them while some outperform many that are still in the USPTO such as Nathan Hillery, Hung Havan, Michele Choi, Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Dwin Craig, Paul Rodrigues, PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE)? 

 

Further signs of abuses toward first year probationary employee - I was constantly feeling the threat of termination if I didn’t perform at 100% or 3 cases per bi-week, by my SPE Paul Rodriguez, Hung Havan and Nathan Hillery- a Union Rep., hence I had to work nearly 24/7.

 

I didn’t know why so many were so resentful and bitter toward the USPTO, now I see why.  It is a pure cesspool.  You allowed the likes of Susanne Lo’s friends-from-India and their countrymen, Tuan Nguyen and his countrymen, Hung Havan, Michele Choi, Nathan Hillery, Shawn Joseph, Dwin Craig, and PETER D COUGHLAN (of AU2122 with Kakali Chaki as SPE) make USPTO into a cesspool.  These people had made my life a living hell.

·         I wanted every American (of all colors and races) aware of this kind of smear campaign tactics being practiced by people from Asia such as Tuan Nguyen and his countrymen, Susanne Lo’s friends-from-India and their countrymen,  Hung Havan and Michele Choi toward Americanized Asian-American women as a way to compete for American jobs.  This been going on since the late 1990s, as I learned from working in the Silicon Valley. 

·         I wanted every top level management to be aware it is not because there are no qualified American candidates for the job, but are being targeted by people from Asia and terminated, women in particular.  No one seems to dare to speak up about this.

 

 

 

 

What remedy(ies) do you seek for the alleged discrimination?

 

1.       I asked POPA from Nathan Hillery to Howard Locker to interfere on the day of my termination as it was a short notice.   As a matter of fact, nearly all TC2100 POPA representatives unwilling to help me.  Even though Howard Locker did send an email to Wendy Gerber, but he said there is not much they could do as I am a probationary employee.  That’s why the USPTO in such a rush to terminate me - a top Chinese female performer, as a way to keep Chinese women down; I have very little protection and rights as a probationary employee.

 

2.       I was also afraid to seek out remedy because 

a.       I am on my 1 year probation; USPTO could easily terminate me just to avoid troubles; as evidenced by my termination.  They obviously have no qualm about firing someone whatsoever, whether justified or not. 

b.      Retributions from the people I reported; been done to me before in the Silicon Valley.  These people-from-Asia are still targeting me in a well-organized and well-planned way using social networking on the Internet. 

c.       I barely have time to sleep, reporting this would take time out of my patent examining time.  I had to meet production or be terminated.  Apparently, I am terminated even though my Productivity at 93% on the 8th month Employee/Evaluation/Assessment/Individual Development Plan and an air-tight case as my first case.
